where the family of jahi mcmath is trying to come up with a solution to keep the teen on life support before a court order expires at 5:00 this evening. the possible options that fell through and what the family is now trying to do -- coming up in a live report. good morning. i'm tori campbell. >> good morning, i'm brian flores. dave clark has the morning off. let's start with weather and traffic. steve is looking far and wide for rain. have you found any? >> not here. sunny and mild. mostly sunny. cooler tomorrow. everything looks fine for new year's eve. new year's day, it will be dry. into the -- not much is changing. temperatures helped with the offshore breeze. it will still be near 70 in santa cruz. a lot of 30s. we lose the breeze and a very dry air mass. it's a very cool morning. it will be another sunny and mild day. maybe a few high clouds to the north. nothing is changing. sunny and mild, just not as warm to very warm as we had

yesterday and still a hint of an offshore breeze. a lot of 60, a few upper 60s. santa cruz maybe near 70. here's tara. we have a traffic hazard on highway 12 westbound at farmer's lane. there's a christmas tree blocking part of the lane. in fremont, a pallet fell off a truck and is blocking the ramp. let's take a look at highway 24 in la fayette. a little slow going as you approach the caldecott tunnel. not too bad. up next, no problems at the bay bridge tacoma. here is a look at the -- toll plaza. here is a look at the eastern span. traffic is flowing nicely. and 101 in san jose, those lights are heading northbound toward the airport. back to the desk. >> thank you, tara. time is running out for the family of jahi mcmath. the 13-year-old girl declared brain dead by doctors is set to be taken off life support later today unless a court intervenes. alex savidge is live with more on this looming deadline.

good morning. >> reporter: good morning. the family of jahi mcmath is planning to file some sort of an appeal with the courts trying to stop children's hospital from taking her life support at 5:00 p.m. today. that's the deadline set by a judge last week, a court- imposed deadline. they are trying to extend that. the family at this point seems to be running out of options. still, they remain hopeful. >> they don't rise up god -- >> reporter: this was the scene yesterday as jahi's family members and their pastor came together to pray at a nearby church in oakland. the family is struggling to find a long-term facility that will accept jahi. the family said last night, their last hope, a facility in new york now is unwilling to care for the 13-year-old girl. jahi suffered cardiac arrest after complex tonsil surgery to

relieve sleep apnea. she's been on a ventilator since that time. court-appointed doctor doctors and the doctors at children's hospital say jahi is brain dead. >> it's rare, if not unheard of, for another facility to accept a person on a vent later. >> reporter: since late last night, her family has been raising money to move her from children's to another facility. so far, people have donated more than $20,000 to a website set up by the family. in order for jahi trab transferred, the girl needs to have surgery to insert a new breathing tube in her throat along with a new feeding tube. children's hospital doctors are refusing to perform those procedures on someone who has been declared legally dead by the courts. later on today, the family is selling ktvu that they do plan to file some sort of an appeal with the state court, the state appeals court asking for more

time, asking to have this deadline, this 5:00 p.m. deadline extended. alex savidge, ktvu channel 2 news. >> all right. thank you. some help is on the way to improve safety on roads in san jose. a city that's experienced a high number of pedestrian deaths in 2013. janine de la vega joins us live from san jose to explain what's happening. janine, good morning. >> reporter: good morning, brian. well, it's starting to get much lighter out here. earlier it was darker. on this stretch of white road near alum rock, you know, there's no street lights. just power poles. it makes it difficult to see pedestrians or cyclists. those who live around here hope that changes. this year there's been 26 pedestrian and cyclist deaths in the city. that's the highest total in about 16 years. the most compared to any other bay area city. in the past couple of month, three children were killed, including a 3-year-old boy, a teenaged girl who was not crossing in a crosswalk on white road and a 17-year-old boy riding a bike on branham.

there's no explain aches for the increase. in -- explanation, for the increase. in several cases, drivers have stopped and in most cases alcohol has not been involved. we spoke to pedestrians in one area where an accident happened. >> i always see thing happen -- not too long ago, somebody ran into this brick wall here and then this happened right here. it's -- it's dangerous. there is a lot of duis, you know, people driving under the influence and speeding through here. they need more cops, they need more lights. it's dark all the way down there until all the way down near. >> reporter: $40 million has been earmarked for improving pedestrian crossingsed on major roadway and where there's been a higher number of accidents. traffic signals will be modified, flashing and high visibility signs will be added. back out here live, it's still

a makeshift memorial for one of the victims who was hit and killed while crossing here at white road at night. a public reminder for pedestrians and motorists to be aware of their surroundings. reporting live from san jose, janine de la vega, ktvu channel 2 news. >> thank you, janine. a nativity scene outside of a southern california church is raising some eyebrows. instead of a baby jesus is features a bloodied sculpture of trayvon martin. the artist says it's meant to get people thinking about the human cost of gun violence. george zimmerman was acquitted in the shooting death of martin earlier this year. this sculpture went up on december 8th and will be taken down january 5th. san francisco teachers say the high cost of housing is forcing them out of the city. according to the chronicle, the average teacher makes $62,000 a year. but a recent exit survey of 96

teachers leaving the district found that 11% of them cited the kofrt of living for the reason -- cost of living for the reason for leaving. there are programs to help buying a home but some say those programs don't go as high as needed. the minimum wage is due to rise in san francisco and one other city. it will go up 19 cents in san francisco. in san jose, their minimum wage go to 10.15. and in california, in july, the minimum wage will jump to $9. california is set to become the first state in the nation to give transgender students new life rights. a new law will allow them to go into rest rooms and play on sports teams. a conservative group is fighting to repeal the law saying it violates the rights

of other students. it says it's collected hundreds of thousands of siles in hopes of putting the issue in front of voters. opponents of building a new warriors arena on the waterfront, opponents say they support a new arena for the team, just not on that site. instead, they suggest the bill graham civic auditorium or part of the moscone center. another option is using the site of candlestick park once that stadium is torn down. but city officials say these proposals are impractical because most of them are landmarks. california's coming to the end of one of the driest came listen der years on record -- came -- calendar years on record. east bay m.u.d. saw just 4 1/2 inches of rain since october which is 30% less than average. if the agency does not see signature rainfall soon, the

water in storage will not last long. >> cautiously monitoring the rainfall situation and the snowcation. in february, if things don't begin to change, we would begin to take steps to prepare. >> if east bay m.u.d.'s board decides to declare a drought, a decision will be made in may. a statewide drought is a possibility. the governor has created a task fierce to monitor the east issue. santa clara county water officials say it this is causing -- this is causing major prosh bleles for wildlife that re-- problems for wildlife that rely on the water. they say it's not necessary at this time to support water conservations. usually decisions like that are not made until later in the winter. happening now -- if you are heading to the waterfront, you are being urged to take pictures of the king tides.

welcome back to "mornings on 2." 7:13. we're learning new information this morning about two deadly explosions in russia. russian investigators believe both are acts of terrorism. yesterday, a bombing at a train station killed at least 17 people. this morning another bombing on a bus killed another 14 people. well, these bombings happen just weeks before the olympic games are set to begin in sochi. kyla campbell, live in our washington, d.c. newsroom where

she just spoke to the state department. kyla? >> reporter: my contact at the state department tells me officials will hold a briefing at 10:00 a.m. pacific today to provide the latest details on these two bombings in russia. this morning, a suede blast on a trolley car killed at least 14 people and yesterday, a suicide bombing killed 17 people at the city's railway station. russian officials say the bombs used are similar and the attacks are likely connected. no one has claimed responsibility yet, but these bombings come months after a rebel leader called for attacks on civilians in russia. that same leader has ordered muslims to "disrupt the olympics in february." what russian officials have to say about this safety at those upcoming winter games, i'm working on that story for you for 8:15. live in washington, kyla campbell, ktvu channel 2 news. >> thank you, kyla. a nationwide manhunt for a

suspected bank robber and cop killer is now over. phoenix police say they shot and killed a suspect saturday morning after another bank robbery. police identified the deceased suspect as 40-year-old mario edward garnett. police say he had a history of mental problems and was arrested in 2010 for making threats against president obama. >> there are numerous leads which we must continue to follow and questions which we must answer. >> the fbi says it started last monday morning when a man attempted to rob a bank in atlanta. authorities say they believe that man then went to mississippi where he held up a bank and killed a police officer. investigators say cell phone records confirm garnett was in all three locations during the time of those robberies. san francisco police are searching for a gunman in a deadly weekend shooting. it happened right across from the movie theater on post

street just before 2:00 sunday morning. police say the victim, a 36- year-old man from modesto was leaving a nearby nightclub when someone opened fire. investigators are asking for any witnesses to come forward. marijuana dispensaries in colorado are making their final preparations for the legal sale of recreational marijuana. on friday, owners of 42 different dispensaries started picking up their licenses. starting on january 1st, dispensaries with that license will be able to legally sell recreational marijuana. colorado will be the first state in the country to have government license stores. nearly four years after it was signed, president obama's healthcare program goes into effect on wednesday. administration officials report about 1.1 million people have enrolled in health plans using the federal website. they say most of those people enrolled in the last couple of weeks after problems with the site were fixed. the obama administration hopes to have seven million people signed up by the end of march. the next time you go to the

vending machine, get ready to count your change and calories. under president obama's healthcare law, most vending machines will be required to list the calories of each item. the fda believes the information will help people make healthier choices. >> i think sometimes, like, when we are at the vending machine forget those things tack on calories. i think it being up front will be helpful. >> about 5 million vending machines across the country will be affected. the change is expected to cost the vending machine industry millions of dollars. >> i have to say i used to have a brand muffin every morning for breakfast out of a vending machine. 640 calories. >> wow. >> i changed. let's go to tara filling in for so. what's going on for in solano county? >> those bran muffins get you every time. you think you are below fat.

no. don't buy it. we have a very large tire in the roadway up in fairfield. several cars have swerved to hit -- to miss it. this is the area right here where you can see all of these arrows. kind of went happy with the arrows to show you exactly where it's located 680 northbound at goldhill road offramp. that's where one driver actually had her bumper torn off. so the chp is trying to get it out of the roadway. in pittsburgh, highway 4, westbound traffic, the headlights there are you see, looking hazy. but no delays as you make the drive to concord. 280 -- is not 280. this is 101 in san jose. you can see that traffic is moving very nicely. the folks with the tail lights are the people making the drive toward the airport. let's check in with steve. >> thank you, muffin. >> you are welcome ginger snap. i've painted a very pretty

picture. for those of you multitasking, you are listening but not watching. i will get out of the way so you can see it. another beautiful sunrise over the city. it will be a beautiful day, just not as warm as yesterday. howling breeze. that's an offshore breeze. if it were june or july, we would be 105. it's that kind of pattern. yesterday we had plenty of records if you were out at sfo, maybe coming back from the midwest, it was freezing. also for oakland airport, 72 there. mountain view, 68. all records. rainfall is the big concern. now, again, 1976, there is a little discrepancy, it's in the mix but they are fine tuning some of these climate data records. 1917 is the driest. 9 inches of rain fell in san francisco. we have 5.59 for the calendar year. it's a record dry. just amazingly dry. we're shattering that record. high pressure is here and it's not going anywhere any time

nada and -- ensenada and tijuana. officials say it may take as long as a year to repair. a ban on backyard and open burning is in effect for the east bay and south bay right now. state fire officials say the dry conditions have led to an increase in fire danger and they are not taking any chances. the ban covers alameda,:00 cblg, san mateo and santa cruz counties it will -- contra costa, san mateo, and santa cruz counties. it will remain until there's a signature amount of rainfall. steve says there's no indication of any rainfall in the forecast. violaters face fines of $200. the washington redskins have just fired mike shanahan. shanahan had one year remaining in his five-year, $35 million contract. the team's owner is looking for

his eighth head coach in his 16th season as owner. two other head coaches have been fired by the teams. the vikings fired leslie frazier after three years. minnesota finished the year with five win, ten losses and one tie. and yesterday, cleveland fired rob chudzinski after one see on the job -- season on the job. today the oakland raiders will pack up their lockers and plan for next season. the raiders played their final game yesterday. they took on peyton manning and the denver broonkg course. first quarter, no score. manning hits decker for the quick score. denver up 7-0. later on in the first, still 7-0, following a raider fumble. manning finds moreno from about seven yards out. that puts denver up 14-0. they win it 34-14, the broncos did and they locked the number one seed in the afc. the 49ers have clinched the number five seed in the

bulls. maybe one got loose. let's take a look outside. highway 4 through the pittsburgh/baypoint area. you can see traffic moving nicely. at the bay bridge toll plaza, we haven't seen too much traffic. a lot of folks probably had the time off for the holiday. down in the south bay, 280 san jose, you can see it's a lot brighter out. you can see everything is moving very well. let's head over to steve. the the desk. sorry. >> thank you, tara. someone took an ambulance when paramedics were inside a home responding to a call. katie utehs is live in daly city with more on how the police found the ambulance and what else was missing. katie, good morning. >> reporter: good morning. the person who stole the ambulance took a relatively short joyride, police located the vehicle within less than a mile from where it was taken. but the thief did make off with the medical supplies. let me show you video from overnight. the theft happened around 12:15

as paramedics with american medical response along with the daly city fire department responded to a call for help. a person who lives on shwirin experienced blood sugar problems. they didn't need to be transported. paramedics stepped outside of the home, a short while later, only to discover the ambulance was not there. investigators found the vehicle ditched nearby within a few minutes. the thief or thieves took medical supplies before running away but police have not confirmed exactly what was taken. now, within the last 15 minutes, i've spoken with amr's media representative. he's looking into the incident checking with dispatchers and also the people who were on the call to see if he can release any additional details, i'm asking them if this is the first time they've experienced this problem or if it's a common occurrence to have ambulances targeted. at this point, police say they've not had any suspect

information. live in daly city, back to you. in the final agreement worked out between b.a.r.t. and the unions, bart will get a chance up to $500 in bonuses. according to the chronicle, under the new contract, b.a.r.t. agreed to pay the workers $500 for every 1% that core commuter ridership exceeded expectation. because of the two recent strikes, ridership is down but b.a.r.t. will honor the bonuses because of the family leave. 7:34. today, a san francisco judge will hear more arguments about whether city college of san francisco will be allowed to stay open. hundreds of teachers and students gathered outside of the courtroom last week as the judge began hearing arguments on two separate lawsuits. they are trying to keep the school acrede daths from being -- accreditation from being taken away in july.

if the judge grants the injunction, it will remain in place until a trial can be held. football fans helped raise money to help 19-year-old dominique romero from richmond paralyzed by a stray bullet. volunteers at a tailgate outside of the raiders' game collected donations. it was put together by a group called make oakland better. dominique's mother is grateful for the community spirit helping her daughter. >> raider nation people are awesome. people are out here helping me, supporting me. asking me what i need and somebody comes and we tell them what we're doing. it's awesome. >> her mother says she's doing well and working on her physical therapy. police have not arrested a suspect in the december 14th shooting. investigators plan to release updated information about the deadly shooting at a denver high school. the sheriff's office is scheduled to hold a news conference this morning. 17-year-old claire davis, a senior at the school was shot. she died a week later after

spending eight days in the hospital. deputies say the shooter was probably trying to track down a teacher who had previously disciplined him. a german magazine this morning has a new report about activity by national security agency hackers. the magazine says an elite nsa team has hijacked microsoft's internal reporting system as well as taken advantage of hard ware vulnerabilities. the magazine goes on to say they steal information from tough targets. microsoft says if the reports are true, it would have "significant concerns." this will be a rough week for many people who have been out of work for more than six months. about 1.3 million americans won't be getting unemployment benefits this week. the average check is $300 a week. but republicans argue that adds up to $25 billion a year and say some people have become dependent on that money >> when you extend benefits to

73 weeks or 99 weeks, it encourages some people to stay unemployed too long and that makes it increasingly hard for them to get back into the work force. >> democrats argue jobless benefits get spent right away and that's necessary, not only to help those people but it helps boost the economic recovery. two senators have proposed a three--month extension but it won't be voted on until congress returns from holidays next month. law enforcement agencies will be out in full force over the next few days looking for drunk drivers. dui chts are going up -- checkpoints are going up in several cities tonight. officers are preparing for the new year's holiday. chp has announced all available officers will be on duty tomorrow night for new year's eve to make sure the roads are safe. well, the city of san francisco is gearing up for one of the biggest parties of the year, the new year's celebration and fireworks show. restaurants, bars and hotels are gearing up for the holiday.

that means big crowds are expected to gather along the waterfront for the annual fireworks show which happens at midnight. >> it feels like a lot of our bests are willing to spend a little bit more money to have a really good time this year. >> thousands of people are expected to be in san francisco this year so the city is urging people to plan ahead. san francisco's muni is offering free ridessed on new year's eve. people can ride muni, light rail and cable cars on all rains and routes for no charge. the free service starts at 5:00 p.m. and runs until 3:00 a.m. new year's day -- 5:00 a.m. new year's day. yesterday, spiderman helped prepare for the event in times square. confetti will be released by hand from vary dwrus buildings when the -- various buildings

two days left in 2013. s&p 500 is on track for an annual gain of 29%, best year since 1997. taking a live look at the big board, the dow is up almost 14. the nasdaq is down 8. s&p down 1. u.p.s. and many e-tailers say they are already looking for ways to improve next year's holiday services. u.p.s. says all of the packages it promised to have on doorsteps by christmas finally made it to their destinations by saturday. zazzle is listening to customer complaints to find out where problems occurred. overstock is giving customers refunds for items that did not arrive on time. experts predict more people will shop online next year despite all of the issues in delivery this year. if you have been thinking about buying a new car, don't way. experts say tomorrow is the best day of the year to buy a new car. dealers are offering cash rebates and 0% financing but

snowstorms this month in addition to the ice storm. meantime, an overhang has collapsed off the roof of a ballroom in duluth, minnesota. it fell down shortly after 8:15 saturday night. the duluth fire department is currently investigating the cause of the chance. right now, fire officials are saying heavy, wet snow may have been the cause. no injuries have been reported. 7:43. we're learning new information about the condition of formula one racer michael schumacher. he suffered severe head trauma over the weekend while skiing in france. michael schumacher hit his head on a rock. he was wearing a helmet but is in a coma and remains in critical condition. today, doctors say they won't offer a prognosis. a crash between a car and a san francisco fire truck sent two people, including a firefighter, to the hospital. the accident happened just before 11:00 yesterday at fifth and howard in the city's south of market neighborhood. the firefighter and the driver of the car were treated at the

be ticketed for not maintaining that safe distance as well or if the emphasis will be on the driver. but confrontations between cyclists and drivers in many cities is a problem. >> well, i think -- you know, whether these things are practical or not, certainly it would benefit if they could get along better on the road. >> that's what a lot of these laws are designed for, people getting along better and being safer. many wonder how something like that could be enforced. some other laws include the carpool lane stickers. those will be extended until 2019. but some of the other safety laws that will be in place put stricter regulations on texting behind the wheel. that takes effect on wednesday. right now texting while driving is only legal in you are using -- if you are using voice activation with a hands-free device. after the first of the year, it will be illegal for anyone under the age of 18 to text

gallon. san francisco drivers are paying an average of 3.72. just about everywhere else, the price is about 3.64. industrial analysts say we should expect prices to top $4 by march. 7:54. east bay families enjoy the lindsay wildlife museum every weekend. but leaders of the nonprofit say they may have to cut back on some programs. so far this year, the museum which also serves as a hospital for wildlife has treated 5600 animals from injured birds to other local wildlife. but animal rescue and rehabilitation eats up a large portion of the center's budget. >> we've been operating on a smaller budget. we've had about 20% less donations this year than in previous years. >> since the economic downturn donations have dwindled. the center only receives a small portion of the funding from government sources. so now they are asking

no delays. let's head back to the desk. well, today doctors at oakland children's hospital could remove 13-year-old jahi mcmath from life support. mcmath was declared brain dead following tonsil surgery. alex savidge, live in oakland with more on what the family is hoping for today. alex, good morning. >> reporter: good morning. later on today, jahi mcmath's family may go to court seeking a new restraining order, trying to stop children's hospital from taking the girl off life support at 5:00 p.m. today. that is the deadline that was imposed by a judge last week. the family at this point appears to be running out of options. they've not been able to transfer the teenager to a long- term care facility. still, though, they remain hopeful. >> that they don't rise up, god, individually -- >> reporter: this was the scene yesterday as jahi's family and their pastor came together for a prayer service at a nearby church. the family right now is working to find a long-term care

facility that will accept jahi but their options appear to be limited. the family said last night, their last hope, a facility in new york, has now said it's unwilling to care for the 13- year-old. jahi suffered cardiac arrest following what children's hospital terms complex tonsil surgery. she's been on a ventilator since the surgery. children's hospital's physicians along with a court- appointed doctor have all said jahi is brain dead. >> she has no chance of coming back under any circumstance. when 5:00 comes around, the ventilator will be removed. >> once she wake up, she's gonna shake up a whole lot of people around here that didn't believe what i see. >> reporter: since late last week, jahi's family has been working to pay for a transfer to a long-term transfer facility. the website says they've raised more than $20 thurk in a matter

of -- $20,000 in a matter of a few days. in order to be transferred, she needs to have surgery done to insert a new breathing tube into her throat and insert a new feeding tube as well. doctors here are refusing to perform those procedures on someone who has been declared legally dead by the courts. later on today, though, the family says they could appeal to the state appeals court trying to get a new restraining order hoping for more time with the 5:00 p.m. deadline looming. alex savidge, ktvu channel 2 news. >> reporter: good morning, tori. we're here near alum road on white road. we're told by neighbors that the city put up the crosswalk

and pedestrian crossing sign. the city plans to add more of these to help with safety. so far there's been 26 pedestrians and cyclist deaths in the city. that's the highest total in about 16 years. the most compared to any other bay area city. in the past couple of months, three children were killed including a 3-year-old boy, a teenaged girl who was crossing at night on white road and a 17- year-old boy riding a bike on branham. officers don't have an explanation on why there's been an increase. but police say both pedestrians and drivers need to pay closer attention as well as not get distracted with mobile devices. we spoke to a pedestrian where an accident happened who said he would like to see more street lights. >> i think if the driver is not seeing the kids walking across the -- it's dark here. it's real dark here. they are probably wearing dark

george zimmerman was acquitted in the shooting death of trayvon martin earlier this year. the sculpture went up on december 8th and will be taken down on january 5th. san francisco teachers say the high cost of housing is forcing them out of the city. according to the chronicle, the average teacher makes around $62,000 a year. a recent exist survey of 96 teachers leaving the district found that 11% of them cited the cost of living for the reason they were leaving. some teachers say there are government programs available that help with buying a first home but say those programs don't go as far as some middle class people need. 8:06. the minimum wage is about to increase in the bay area's two largest cities. on new year's day, minimum wage in san francisco will go up 19 cents. it will be $10.74 an hour. the second highest in the country. and san jose's minimum wage will increase 15 cents to 10.15 an hour. on july 1st, california's minimum wage will jump a dollar

to 9 an hour -- $9 an hour. california is set to become the first state in the nation to give transgender students specific rights. a new law goes into effect allowing transgender students to allow restrooms and play on sports teams that correspond to the gender they identify with. a conservative group is fighting to repeal the law saying it violates the rights of other students. it has collected hundreds of thousands of signatures in hopes of putting the issues in front of voters. >> opponents of building a new arena, according to the chronicle, they oppose a new arena for the warriors but not at the site. they suggest the bill graham civic auditorium or part of the moscone center. another option, using candlestick park once the stadium is tore down.

california is coming to the end of one of the driest calendar years on record. many of the bay area water agencies say the lack of rain is causing drought concerns. east bay m.u.d.'s sierra watershed saw just four and a half inches of rain since october which is 30% less than average. if the anjen -- agency does not see significant rainfall soon, the water in storage won't last long. >> cautiously monitoring the rainfall situation and the snow situation. in february, if seeing change, we would begin to take steps to prepare. >> if the east bay m.u.d. board deed sides to declare -- decides to declare a drought, that decision would be made in may. the governor has created a task force to monitor the issue. meantime, south bay reservoirs are about 34% of their normal levels. with such little rainfall, many creeks are drying up. santa clara county water officials say it's causing

major problems for wildlife that rely on the creeks for waters. the water district says while the conditions are a problem. right now it's not necessary to enforce mandatory water conservation. usually decisions like those are not made until later in the winter. happening now -- if you are heading to the waterfront you are being urged to take pictures of king tides. these are live pictures from the embarcadero in san francisco in the city where the average high tide is 6 feet, the king tides are expected to be almost 7 feet by later this morning. so you can see they might lap up over on the piers there. the tide are expected to peak about 9:00 this morning. these unusually large high tides are expected to hit the coast every day through thursday. >> it seems like it's more and more. sometimes we run by here and you can see the water has really washed up. i don't think that's really typical. >> a push known as the

morning. police say the victim, a 36- year-old man from modesto, was leaving a nearby nightclub when someone opened fire. investigators are asking for any witnesses to come forward. 8:15. marijuana dispensaries in colorado are making their final preparations for the legal sale of recreational marijuana. on friday, owners of 42 different dispensaries started picking up their licenses. starting on january 1st, dispensaries with the license will be able to legally sell recreational marijuana. colorado will be the first state in the country to have government licensed stores. nearly four years after it was signed president obama's healthcare program goes into effect on wednesday. administration officials report about 1.1 million people have enrolled in health plans using the federal website. they say most of those people enrolled in just the last couple of weeks after problems with the website were fixed.

no delays. we have a lack at the eastshore freeway, traffic on the left side, toward the mawkdz. all morning -- macarthur maze. all morning lock clear sailing into san francisco. back to the desk. >> thank you, tara. we have new details about an unusual overnight crime. police are trying to find the person who stole an ambulance. katie utehs is live in daly city. she just spoke with the ambulance company. they tell us they've had this problem before. >> reporter: good morning. the spokesperson with american medical response tells me that they've had ambulances stolen from their company lots before. but what happened last night is a little different. i'm told that the paramedics left the flood lights running on the ambulance to illuminate the walkway to the house where they were responding and they had to leave the ambulance running to do so. in that time, there were firefighters on scene as well

as police officers but a thief made a bold move and hopped in the vehicle. lit me show you -- let me show you video from overnight. the call came in around 12:15. you can see the stretcher but the ambulance is not where the paramedics parked it. a person experienced blood sugar problems related to diabetes and the paramedics did not need to transport the person but when they stepped outside the home a short while later, they discovered that's the ambulance was nowhere they parked it. the police say the thief made off with medical supplies. however, amr says the supplies are with the paramedics. and the amians didn't have any damage. amr says this is not the first time they've had ambulance stolen. they have been taken from the

company yards. police tell us that they are still looking for the person who took the vehicle. live in daly city, katie utehs, ktvu channel 2 news. >> thank you. under the final agreement worked out between b.a.r.t. and the biggest union, b.a.r.t. workers will get a chance up to $500 in bonuses. that's according to the chronicle which says under the new contract, b.a.r.t. agreed to pay the workers $500 for every 1% that core communeny ridership exceeded expectations. because of the recent strikes, ridership is down but b.a.r.t. will honor the bonus because the unions dropped their claim of the six weeks family paid. management said that was mistakenly included in the contract. a judge will hear more arguments about whether city college of san francisco will allow to be open. hundreds of students and teachers gathered outside of the courtroom last week as the judge began to hear arguments on two separate lawsuits. they are trying to keep the accreditation from being taken

and died a week later after spending eight days in the hospital. deputies say shooter -- the shooter was probably trying to track down a teacher who previously disciplined him. an elite nsa team has hijacked microsoft's reporting system as well as taken advantage of hardware vulnerables -- vulnerabilities, a magazine says. microsoft says if the reports are true, it would have significant concerns. 1.3 million americans who were planning to receive jobless benefits this week will have to do without that money. money for long-term unemployment insurance was not part of the recently passed federal budget. the average check is $300 a week. democrats say benefit checks get spent right away and that's a boost to the economy as well as a life line for the people who get the checks.

down 1. let's get you updated on some of the top stories we're following right now -- police in daly city have recovered an ambulance that was stolen overnight. it hatched around 12:15 -- happened around 12:15 when the paramedics were inside a house helping a patient. police say they found the vehicle nearly five minutes later. nothing was removed from the ambulance. king sides are expected to hit the coast in 20 minutes. in san francisco, the average high tide is 6 feet but the king tides are expected to be almost 7 feet. tomorrow, they are expected to get even bigger. they hit the coast today through thursday. the clock is ticking for the family of jahi mcmath. unless her family appeals to a i hooker court. children's hospital in oakland will disconnect her from life support. she's been on a ventilator since being declared brain dead after a routine surgery. alex savidge has more on the family's attempt to delay the deadline. >> reporter: good morning. her family may head to court at some point seeking a new

restraining order that would prevent children's hospital from removing jahi from life support at 5:00 p.m. today. that's the deadline that was imposed by the courts last week. ever since that time, the family has been working to move her to a long-term care he facility but so far they've been unsuccessful. still, jahi's mother remains hopeful. >> when she do wake up, she's gonna shake up a whole lot of people around here that don't believe what i see. >> reporter: just yesterday, jahi's mother and some other relatives and friends came together for a prayer service at a nearby church here in oakland. the family is trying to find a long-term care facility that will accept jahi but the family said they got disappointing news. their last hope, a facility in new york now says it's unwilling to care for the 13- year-old who suffered cardiac arrest following complex tonsil surgery. ever since that time, the girl'

been on a vent -- the girl's been on a ventilator. children's hospital physicians and a court ordered doctor have all said she's brain dead. a spokesperson says it's highly unlikely she will be transferred before the deadline. >> it's rare, if not unheard of, for another facility to accept a deceased perp on a ventilator -- person hon a ventilator -- on a ven later. >> reporter: since last week, they've been working to raise money to pay for the transfer that they hope will still happen. they've raised about $20,000 on a website they set up. but in order for her to be transferred to a facility, the girl still needs to have surgery for the tubes. and doctors here will not perform the procedures on someone who has been declared legally dead. we do understand according to the family attorney, they told ktvu last night that they may appeal to a state court at some point later on today, hoping

again for more time with a 5:00 p.m. deadline coming later on today. we're live this morning at children's hospital in oakland, alex savidge, ktvu channel 2 news. >> thank you. we're learning new information about the condition of formula one racer michael schumacher. he suffered severe head trauma over the weekend while skiing in france. michael schumacher hit his head on a rock. he was wearing a helmet but is in a coma and remains in critical condition. today, doctors say they won't offer a prognosis. a crash between a car and a san francisco fire truck sent two people, including a firefighter, to the hospital. the accident happened just before 11:00 yesterday morning at fifth and howard in the city's south of market neighborhood. the firefighter and the driver of the car were treated at the hospital and released. people in the area knew something was wrong as soon as they heard the crash. >> i heard like a big bang. so i came outside to check what's going on.

>> i've only been here five months. i have never seen anything that big happen here. >> the crash caused traffic problems when police esclosed the intersection so they could investigate the collision. the new year brings new laws, many of them affecting california roads. ktvu's pam cook is in hour newsroom with what is driving the change. good morning. >> good morning. improving safety on the roads for everyone is the main focus of many of the new laws that take effect this week. one of the new laws that begins on january 1st is directed at teens. if you are under 18, you will no longer be able to text. right now texting while driving is only legal using a hands- free device. after the first, only drivers 18 and older will be able to use that voice acvation. people -- activation. people we spoke to don't think

it will go far enough. >> i think the enforcement that keeps people from being distracted is very important for all of us. disstrarblthed driving -- distracted driving is causing a lot of accidents. it's not just the drivers, it's the cyclists. >> another law, does not take effect until september but many are talking about it now and are concerned. it will require drivers to keep a minimum distance of three feet when passing cyclists. it's not clear if cyclists will be ticketed for not maintaining the safe distance as well or if the burden will be completely on the driver of the car. now, another new law that starts this week, you will no longer be able to transfer ownership of a vehicle even to a family member until all parking and toll violation fines and penalties are paid. new year, new laws. pam cook, ktvu channel 2 news. >> all right, pam.

accidents at washington, d.c.'s metro station is raising questions about whether someone can be too drunk to ride public transportation. since october 7, people have been injured. two in the last week. cameras have caught people falling off the platform and over the side of the escalator. >> they are getting stuck in the doorway. one kid took off his shirt. >> one person died after falling on the tracks and hitting his head. they say his blood alcohol level was well above the legal limit. yesterday's snowstorm brought new power outages to thousands of residents in maine. as of yesterday, there were about 600 customers who still did not have power from the ice storm two weekends ago. but now that number is back up to more than 5600 after last night's snowstorm. according to the national weather service, many parts of maine saw about 6 inches of snow. maine has dealt with several snoerles this month in addition to the ice storm.

meanwhile an overhang collapsed off the roof of a ballroom in duluth, minnesota. fire officials say it fell down shortly after 8:15 on saturday night. the duluth fire department is currently investigating the cause of the collapse. right now, fire officials are saying heavy, wet snow may have been the cause. no injuries have been reported. 8:55. in marin county, they are set to get a $15 million federal grant to fix roads at the point reyes national seashore. it will help restore 22 miles of road leading to the point reyes height laos. it includes -- lighthouse. it includes widening the road, while fixing drainage, cattle crossings and improving parking areas. the grant will become available in 2018. well, several east bay families enjoyed the lindsay -- enjoy the lindsay wildlife every weekend but the nonprofit may have to cut back on programs. so far this year, the hospital has treated 560000 -- 5600
